The Width of Wheels
     

WHEREAS it is expedient to amend so much of the " Tolls

Amendment Act 1857 " as relates to the breadth of Wheels

Be it enacted by t h e Queen's Most Excellent Majesty by and with the

advice and consent of t h e Legislative Council and Legislative Assembly

of New South Wales in Parliament assembled and by t h e authority

of the same as follows :

1. The t h i rd fourth fifth sixth seventh and eighth sections of

the said recited Act are hereby repealed.

2. From the time when this Act shall take effect every cart

dray wain wagon or other such carriage all t h e wheels whereof shall

not be less t h a n five inches wide in the tire and shall be constructed

and fixed or applied in conformity with the provisions hereof shall be

charged with half the toll only to which such cart dray wain wagon

or other carriage would otherwise be liable.

3. I t shall thenceforward be lawful for any Trustee or Commissioner

of any Turnpike Road or their Lessee or for any Collector of

Tolls or for any person acting under the authority of any such Trustee

Commissioner Lessee or Collector to measure t h e breadth of the wheels

of any cart dray wain wagon or other carriage in respect whereof a

reduction of toll is claimed under this Act and otherwise to examine

t h e same to ascertain that the same are constructed and fixed or

applied in conformity with the provisions hereof before such cart dray

wain wagon or other carriage shall be allowed to pass through any

toll gate or bar at which toll shall be payable and every owner or

driver of any such cart dray wain wagon or other carriage who after

such measuring and examination shall have been lawfully required

shall refuse to permit the same or who shall turn or drive out of the

road in order to avoid or evade the same or in any other way wilfully

hinder or obstruct the same shall forfeit all right to a reduction of

toll to which he would otherwise have been entitled under the

provisions hereof in respect of such cart dray wain wagon or other

carriage.

4. The reduction of toll hereinbefore provided shall not be

claimable or allowed in respect of any cart dray wain wagon or other

carriage unless all the wheels thereof in addition to being five inches

wide in the tire shall to the intent and so t h a t when the wheels move

on on a flat or level surface t h e whole width of the wheels shall bear

equally on such surface be constructed and fixed or applied in

conformity with the following provisions namely All the wheels

shall be cylindrical that is to say of the same diameter on the

inside next the carriage as on t h e outside all the tires of the wheels

shall be flat and every axle-tree shall be horizontal that is t o say the

part of t h e axle-tree inserted in one wheel shall not form an angle

with t h e part of the axle-tree inserted in t h e opposite wheel.

5. This Act shall take effect on the first day of January one

thousand eight hundred and sixty-two and not before and shall be

styled and may be cited as t h e " T o l l s Amendment Act 1861."
